External Resources Data Protection Laws - St Vincent & the Grneadines

St Vincent and the Grenadines has made legislative efforts towards data protection with the Privacy Act, 2003, which was enacted to regulate the collection, use, correction, and disclosure of personal data by public authorities. However, as of February 2025, the Act has not yet been brought into force, as the required commencement order has not been issued. This means that, although a legal framework for data privacy exists on paper, it is not currently enforceable, leaving a significant gap in the protection of personal data within the country.

The Privacy Act, 2003, was designed to ensure that personal information held by public entities is managed responsibly, with clear provisions aimed at safeguarding individuals' privacy rights. However, due to its non-enforcement, there is no official regulatory body or enforcement mechanism overseeing data protection in Saint Vincent and the Grenadines.

Despite the absence of an active, comprehensive data protection framework, certain organisations have taken voluntary steps to implement internal data protection policies. For instance, the St Vincent and the Grenadines Environment Fund has issued a privacy notice (https://www.svgef.org/privacy-policy/?), detailing how it handles individuals' personal information. These independent efforts indicate growing awareness of data privacy concerns, even in the absence of a nationally enforced legal framework.
